Please read these Terms and Conditions carefully before using CartWatch. By accessing or using our website at cartwatch.ca, you agree to be bound by these terms. If you do not agree, please do not use our service.
1. About CartWatch
CartWatch ("we," "us," or "our") is a grocery price comparison service operating under the name CartWatch, based in Atlantic Canada. Our service allows users to compare grocery prices across Sobeys, Atlantic Superstore, and Walmart locations in Nova Scotia, New Brunswick, Prince Edward Island, and Newfoundland and Labrador.
2. Use of the Service
CartWatch provides a free and premium price comparison tool for personal, non-commercial use. By using our service, you agree to:
- Provide accurate information when creating an account
- Keep your account credentials secure and not share them with others
- Use the service only for lawful purposes
- Not attempt to scrape, copy, or reproduce our price data or application for any commercial purpose
- Not attempt to reverse engineer, disable, or interfere with any part of the service
3. Accounts
To access certain features you must create an account. You are responsible for all activity that occurs under your account. You must notify us immediately at info@cartwatch.ca if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Free and Premium Plans
CartWatch offers a free tier and a paid Premium tier. The free tier allows you to compare prices and save up to 3 lists. The Premium tier ($4.99/month) provides unlimited saved lists, AI-powered meal planning, recipe generation, and Family Cart functionality.
Premium subscriptions are billed monthly. You may cancel at any time from your account settings. Upon cancellation, you will retain Premium access until the end of your current billing period. We do not offer refunds for partial billing periods.
5. Payments
All payments are processed by Stripe, a third-party payment processor. CartWatch does not store your credit card or payment information on our servers. By subscribing to Premium, you authorize Stripe to charge your payment method on a recurring monthly basis until you cancel. Stripe's terms of service and privacy policy apply to all payment transactions.
6. Price Data Accuracy
CartWatch displays grocery prices that are collected from publicly available sources and updated regularly. We make reasonable efforts to keep pricing current; however, prices displayed on CartWatch may not reflect actual in-store prices at any given time. Prices can change without notice, vary by location, and may differ from what you encounter in-store.
CartWatch makes no warranty, express or implied, regarding the accuracy, completeness, or timeliness of price information. You should always verify prices at the store before making purchasing decisions. CartWatch is not responsible for any losses or inconvenience arising from reliance on displayed prices.
7. Family Cart
The Family Cart feature allows Premium subscribers to share saved lists with one other user. By inviting another user to your Family Cart, you acknowledge that they will have access to your saved grocery lists. You are responsible for ensuring you only invite people you trust. You may remove a Family Cart member at any time from your account settings.
8. Intellectual Property
All content, design, code, and data on CartWatch — including but not limited to the CartWatch name, logo, application interface, and price database — is owned by or licensed to CartWatch. You may not copy, reproduce, distribute, or create derivative works from any part of our service without our express written permission.
9. Disclaimer of Warranties
CartWatch is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CartWatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the service. Our total liability to you for any claim arising from your use of CartWatch shall not exceed the amount you paid to CartWatch in the three months preceding the claim.
11. Third-Party Services
CartWatch integrates with third-party services including Stripe (payments) and Google Analytics (usage analytics). Your use of these services is subject to their respective terms of service and privacy policies. CartWatch is not responsible for the practices of any third-party services.
12. Termination
We reserve the right to suspend or terminate your access to CartWatch at any time, with or without cause, and with or without notice. Upon termination, your right to use the service will immediately cease. If you have an active Premium subscription at the time of termination by us without cause, we will refund any unused portion of your subscription.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of CartWatch after changes are posted constitutes your acceptance of the revised terms. For material changes, we will make reasonable efforts to notify registered users by email.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these terms or your use of CartWatch shall be subject to the exclusive jurisdiction of the courts of New Brunswick.
